This Domain Registration Agreement applies whenever Excelax facilitates the registration, transfer, renewal, or management of a domain name. It supplements the Terms of Service and the rules of the applicable registrar and registry.
1. Our role
Excelax acts as a reseller or service provider between you and the relevant registrar or registry. Domain registrations are ultimately governed by the policies of those organisations, including applicable ICANN policies and, for .ng names, NiRA policies and the NiRA Registrant Agreement.
2. Registration requests
A search result or payment does not guarantee registration. A domain is registered only when confirmed by the registry. Premium pricing, eligibility rules, reserved names, verification requirements, and registry restrictions may apply.
3. Registrant information
You must provide complete and accurate registrant, administrative, technical, and billing details and keep them current. False, outdated, or unverifiable information may cause suspension, transfer restriction, or cancellation under registry rules.
4. Rights and lawful use
You confirm that the requested name and its intended use do not unlawfully infringe another person’s trademark, business name, privacy, or other rights. Registration does not grant trademark rights. You are responsible for responding to disputes and complying with applicable dispute-resolution policies.
5. Fees, renewal, and expiry
Registration, transfer, renewal, redemption, and premium-domain fees may differ and may change when registries or suppliers change their charges. You are responsible for renewing before expiry. Auto-renewal is a convenience and does not remove that responsibility. An expired domain may stop resolving, enter a grace or redemption period, incur additional fees, or become available to another registrant.
6. Transfers
Transfers depend on registry eligibility, domain status, contact verification, authorisation codes, and applicable waiting periods. You authorise us and our suppliers to exchange the information necessary to process a requested transfer.
7. Privacy and disclosure
WHOIS privacy is provided only where supported by the extension and registry. Registration data may still be shared with registrars, registries, escrow providers, dispute-resolution providers, and authorities with a lawful basis. Registry policy may require some data to be published.
8. DNS and nameservers
You are responsible for confirming that DNS and nameserver settings are correct. DNS changes can take time to propagate. Where Cloudflare onboarding is enabled, nameservers are changed only after required records and registrar capability checks succeed.
9. Suspension, cancellation, and registry action
A registrar or registry may reject, suspend, lock, transfer, or cancel a domain under its policies, a dispute decision, court order, law-enforcement request, or legal requirement. Excelax is not liable for registry action outside our reasonable control but will provide reasonable assistance where possible.
10. Authority
If you register for an organisation or another person, you confirm that you have authority to bind that registrant. The registrant remains responsible for the domain and the accuracy of its records.
11. Incorporated policies
Applicable registry and registrar policies form part of this agreement and prevail where their mandatory terms conflict with it. Those policies may change independently of Excelax.
